Promax “Promise” Campaign Specific "Rules"
1. Eligibility:
1.1 Promax is running a Promax "Promise" Campaign Promotion (the “Promotion") from 1 November 2023 to 29 February 2024 (the “Promotion Period”). Promax reserves the right to end the promotion at any time for any reason at their sole discretion.
1.2 To be eligible for the Promotion you must:
1.2.1 Be a New Zealand resident who is over the age of 18 years;
1.2.2 If you have a trade account with Promax, not be in breach of Promax’s trade account terms and conditions; and
1.2.3 Purchase from the promotional range during the Promotion Period.
1.3 You acknowledge that the Promotion is valid for single consumer purchases of selected tanks from the promotional range only. Eligibility is limited to individual sales orders and is not available for bulk purchases, commercial quantities, or trade purchases. Where orders are placed through trade accounts the ‘End User’ will be the eligible entrant (“Participant”).
2. Promotion Details:
2.1 The Promotion offers purchasers of selected rainwater tanks from the limited promotional range an opportunity to negotiate and secure the preferred delivery week and pricing of their order in advance with no deposit required.
2.2 During the Promotion Period, the Purchasers of the selected rainwater tanks from the limited promotional range will go in the draw to win one of the five (5) following prizes:
2.2.1 Four (4) Digital Prezzee Cards in an amount equivalent to NZD $200 per Digital Prezzee Card; and
2.2.2 One (1) ‘Grand Prize’ including Traeger Pro 575 Pellet Grill (RRP $1699.00), Yeti Roadie 24 Cooler (RRP $349.00) and selection of Promax branded merchandise, valued at over $2000.
2.3 Promax reserves the right to substitute any of the prizes for a similar product, if the stated prize is unavailable at the time the Promotion ends, or for any other reason at Promax’s sole discretion.
2.4 Each month during the Promotion Period, four (4) Winners of the $200 Digital Prezzee Cards will be drawn from all entries received during the Promotion Period. One (1) Winner for the ‘Grand Prize’ will be drawn from all entries received during the Promotion Period. The ‘Grand Prize’ draw will be on Monday 25 March 2024.
2.5 All prizes will be drawn using a random number generator.
2.6 The Winner will be notified by phone (voice or text) or email or using other contract details that you provide Promax. Where attempts to contact the Winner fail (e.g., when the Winner cannot be contacted by phone or email after three business days) or that the Winner is unable to use the Prize, the Judge will select another Winner. If, after successful notification, the Prize is not collected within four (4) weeks of being announced it will be regarded as forfeit.
2.7 There is a limit of one Digital Prezzee Card per Winner. Multiple purchases of rainwater tanks by the same Participant will not result in additional Digital Prezzee Cards.
2.8 In the event of multiple rainwater tanks being purchased in a single transaction, only one Digital Prezzee Card will be issued to the Winner.
3. Redemption:
3.1 The Digital Prezzee Card will be made available to the Winner to redeem after delivery of the rainwater tank is completed.
3.2 The Digital Prezzee Card can be redeemed in accordance with the Prezzee Card terms and conditions and available at www.prezzee.co.nz.
3.3 Promax is not responsible for any lost, stolen, damaged or expired Digital Prezzee Cards.
3.4 The Digital Prezzee Card is valid for a limited period as recorded on the card itself and cannot be used after the expiry date recorded on the card.
4. General Conditions:
4.1 By participating in the Promotion, participants agree to be bound by these Specific Rules and as well as the Rules, general terms and conditions available on the Promax website at https://www.promax.co.nz/terms-conditions.
4.2 Standard Freight terms and conditions apply. For aboveground tanks of 10,000L or greater, refer to the freight terms and conditions provided at https://www.promax.co.nz/freight-terms-conditions.
4.2.1 Delivery Cancellation Fee’s will be strictly enforced. Customer requests for an alternative delivery date, rescheduling or re-routing of the carrier or inability to unload at site, may incur a return or storage fee:
4.2.2 Rescheduling – to reschedule a planned delivery, a fee of up to $800 plus GST may apply depending on location;
4.3 Cancellation – a cancellation of a product already in the production process will incur a 40% cancellation fee.
4.4 Promax’s decision regarding any aspect of the Promotion, including but not limited to allocation of the prizes, will be final and binding.
4.5 Promax may use the personal information collected from Participants in accordance with applicable privacy laws and regulations.
4.6 To the extent permitted by law, Promax [and its affiliated entities, directors, officers, employees, and agents] will not be liable for any direct or indirect, incidental, consequential, or punitive damages arising out of or related to the Promotion or for personal injury as a result of Promotion entry of winning a prize.
5. Acceptance
5.1 Participation in the Promotion is deemed acceptance of these Specified Rules and the Rules.
5.2 If the Winer does not accept these Rules, the prize will be forfeited.
